These Terms of Service apply to your use of our website, online store, customer accounts, subscriptions, products, content, promotions, competitions, ambassador links, affiliate links and any related services we provide.

By accessing our website, creating an account, purchasing from us, subscribing to our products, entering a promotion, using an ambassador or affiliate code, or otherwise using our services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you should not use our website or purchase from us.
Nothing in these Terms limits, excludes or modifies any rights you may have under the Australian Consumer Law or any other law that cannot legally be limited, excluded or modified.
1. Eligibility and account access
By using our website or purchasing from us, you confirm that you are at least the age of majority in your state, territory or country of residence, or that you have permission from a parent or guardian.
You may be asked to create an account or provide information to place an order, manage a subscription or use certain features of our website.
You agree that any information you provide to us is accurate, current and complete.

We make reasonable efforts to describe and display our products accurately, including ingredients, nutrition information, flavours, packaging, pricing and availability.
However, product packaging, appearance, colours, images, batch details and availability may vary from time to time.
Product images on our website are for general reference only. The colour or appearance of products and packaging may differ depending on your device, screen settings, photography, production runs or packaging updates.
We may change, update, discontinue or limit products at any time, subject to applicable law.
3. Nutrition, fitness and product information
FLOK products and website content are provided for general information only.
Any information we provide about training, performance, ingredients, nutrition, digestion, energy, carbohydrates, sodium, hydration, exercise, lifestyle or product usage is general in nature and is not medical advice, health advice, dietary advice or personalised sports nutrition advice.
You should consider your own circumstances, allergies, intolerances, dietary needs and health requirements before consuming our products.
If you have a medical condition, food allergy, intolerance, specific dietary requirement, or are unsure whether a product is suitable for you, you should seek advice from a qualified health professional before consuming the product.

4. Orders
When you place an order through our website, you are making an offer to purchase the products in that order.
Your order is accepted when we confirm acceptance, process payment and/or send an order confirmation.
We may refuse, cancel or limit an order where reasonable, including if:

Please review your order carefully before submitting it. We may not be able to change or cancel an order after it has been placed, particularly once it has entered fulfilment or dispatch.
5. Personal use only
Unless we agree otherwise in writing, products purchased from our website are for personal or household use only.
You must not purchase products for unauthorised resale, export, commercial distribution or marketplace resale.
We may refuse or cancel orders that appear to be for unauthorised resale or commercial distribution.
6. Pricing, promotions and discounts
Prices are shown in Australian dollars unless stated otherwise.
Prices, discounts, bundles, subscription offers and promotions may change without notice.
The price charged for a product will be the price displayed at checkout at the time you place your order, subject to correction of obvious errors.
Unless stated otherwise, prices may not include shipping, handling, duties, taxes, customs charges or other fees.
Discount codes, ambassador codes, affiliate codes, referral codes and promotional offers:

may be subject to additional terms;

may have expiry dates, minimum spend requirements or usage limits;

may not be combined with other offers unless stated;

may be changed, suspended or withdrawn at any time;

must not be used fraudulently or in a way that breaches these Terms.
If there is a conflict between these Terms and the terms of a specific promotion, the specific promotion terms apply to that promotion.
7. Payments
You agree to provide current, complete and accurate payment and billing information.
Payments may be processed through Shopify Payments, PayPal, Afterpay, Apple Pay, Google Pay, Shop Pay or other payment methods made available at checkout.
Payment providers may have their own terms, fees, eligibility criteria and privacy policies. We are not responsible for the acts, omissions or decisions of third-party payment providers.
You confirm that you are authorised to use the payment method provided.
8. Subscriptions
If you sign up for a subscription, you authorise us and our payment providers to charge your selected payment method on a recurring basis according to the subscription plan you select.
Subscription details, including product quantity, pack size, delivery frequency, renewal timing, price, discounts and cancellation options, will be displayed during checkout or in your customer account.
You are responsible for managing your subscription, including keeping your payment details, shipping address and account information up to date.
Unless stated otherwise at checkout or in your subscription settings:

subscription orders renew automatically;

your payment method will be charged before each subscription order is fulfilled;

subscription changes, skips or cancellations must be made before the renewal order is processed;

if an order has already renewed, been charged or entered fulfilment, we may not be able to cancel or change that order.
You can manage or cancel your subscription through your account, subscription portal, or by contacting us at sup@flokyeah.com.
If a payment fails, we or our subscription provider may attempt to process the payment again, contact you for updated payment details, pause your subscription or cancel your subscription.
We may update subscription products from time to time, including changes to product flavours, pack sizes, quantities, prices, discounts, delivery frequency, shipping options, inclusions or subscription benefits.
If a change affects the price you pay, the number of products you receive, or another material part of your subscription, we will give you reasonable notice before the change applies to your next renewal.
If you do not want to accept the change, you can cancel, pause or update your subscription before your next renewal is processed.
We will not apply a price increase to an existing subscription without giving you prior notice.
Subscription discounts, free gifts, promotional pricing, pack sizes, product inclusions and subscription benefits may be changed, withdrawn or subject to conditions. If a change materially affects your subscription, including the price you pay or quantity you receive, we will give you reasonable notice before the change applies, unless otherwise required by law.
Nothing in this section limits your rights under the Australian Consumer Law.
9. Shipping and delivery
We deliver using Australia Post, Sendle and other delivery providers. In the future, we may also use third-party logistics providers, warehouses or fulfilment partners.
Delivery times are estimates only and may vary due to carrier delays, weather, public holidays, peak periods, address issues, customs processing, operational issues or events outside our reasonable control.
We will use reasonable efforts to fulfil and dispatch orders within the timeframes communicated on our website or in your order confirmation.
You are responsible for providing accurate and complete delivery details. We are not responsible for delivery issues caused by incorrect, incomplete or outdated delivery information provided by you.
If your order is delayed, lost, damaged or not delivered, please contact us at sup@flokyeah.com so we can investigate with the delivery provider and assist you where required by law.
Nothing in this section limits your rights under the Australian Consumer Law.
10. Returns, refunds and consumer guarantees
Your purchases are subject to our Refund Policy.
Nothing in our Refund Policy or these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a replacement, refund or other remedy if a product fails to meet a consumer guarantee, including where the product is faulty, unsafe, not as described, not of acceptable quality, or otherwise does not meet a guarantee that applies under law.
We are not required to provide a refund or replacement simply because you change your mind, find the product cheaper elsewhere, choose the wrong product, dislike a flavour, or no longer want the product, unless required by law or stated in our Refund Policy.

11. Allergens and food safety
Our products may contain or come into contact with allergens.
You are responsible for checking the product label, ingredient list and allergen information before consuming a product.
If you have an allergy, intolerance or specific dietary requirement, please contact us before purchasing if you are unsure whether a product is suitable.
We do not guarantee that any product is suitable for all individuals or dietary needs.
12. Competitions, giveaways and promotions
From time to time, we may run competitions, giveaways, waitlists, referral campaigns, ambassador promotions or other promotional activities.

Where you submit feedback, reviews or content to us, you grant FLOK a worldwide, royalty-free, non-exclusive licence to use, reproduce, edit, publish, display, distribute and promote that content for business, marketing, product development and promotional purposes.
We may moderate, edit, remove or decline to publish reviews, feedback or user content at our discretion, including where we believe it is false, misleading, offensive, unlawful, spam, unrelated or in breach of these Terms.
14. Intellectual property
All content on our website and related services, including text, graphics, logos, icons, images, product names, packaging, designs, videos, audio, downloads, trademarks, branding, website layout and other materials, is owned by or licensed to FLOK and is protected by Australian and international intellectual property laws.
You may use our website for personal, non-commercial purposes only.
You must not copy, reproduce, adapt, modify, distribute, sell, exploit, scrape, republish, upload, post, transmit or use our content, branding or intellectual property without our prior written consent, except as permitted by law.
FLOK names, logos, product names, slogans, designs and branding are trademarks or brand assets of FLOK. You must not use them without our prior written permission.
15. Third-party tools, apps and links
Our website may include tools, apps, payment options, subscription services, loyalty tools, review tools, affiliate tools, social media integrations, links or other functionality provided by third parties.
These third-party services may be subject to their own terms, privacy policies, fees and conditions.
We are not responsible for third-party websites, platforms, apps, tools, services, content, errors, acts or omissions, except to the extent required by law.
If you access third-party links or use third-party tools, you do so at your own risk.
16. Shopify
Our store is powered by Shopify.
Any sale or purchase you make through our store is directly between you and FLOK.
Shopify is not responsible for any aspect of the sale between you and FLOK, including product issues, delivery issues, refunds, injuries, losses or damage relating to products purchased from us.
You release Shopify and its affiliates from claims, damages and liabilities arising from or relating to purchases and transactions with FLOK, to the extent permitted by law.
17. Privacy
Our handling of personal information is described in our Privacy Policy.
By using our website, creating an account, purchasing from us, entering a promotion, subscribing or otherwise interacting with us, you acknowledge that you have read our Privacy Policy.
Because our store is powered by Shopify and uses third-party providers, your personal information may be collected, processed, stored or disclosed by Shopify and other service providers in Australia and overseas.

You must not use our website, products, services or content:

To the maximum extent permitted by law, FLOK and its directors, officers, employees, contractors, suppliers, service providers, partners and affiliates are not liable for any indirect, incidental, special, consequential or punitive loss or damage, including loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption or similar losses.
To the maximum extent permitted by law, our total liability to you for any claim relating to your use of our website, services or products is limited to the amount paid by you for the relevant product or service giving rise to the claim.
Nothing in these Terms excludes, restricts or modifies any rights, remedies, guarantees or warranties under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
24. Indemnity
To the maximum extent permitted by law, you agree to indemnify FLOK and its directors, officers, employees, contractors, suppliers, service providers, partners and affiliates against losses, damages, liabilities, costs and expenses arising from:

Termination does not affect rights and obligations that arose before termination.
Sections that by their nature should survive termination will continue to apply, including sections relating to intellectual property, user content, disclaimers, limitation of liability, indemnity, privacy, governing law and dispute resolution.

These Terms are governed by the laws of New South Wales, Australia.
You and FLOK submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.
28. Changes to these Terms
We may update these Terms from time to time.
The current version will be posted on our website with the “Last updated” date.
If we make material changes, we will take reasonable steps to notify you where required by law.
Your continued use of our website or services after the updated Terms are posted means you accept the updated Terms.
29. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be severed to the extent necessary, and the remaining parts will continue in full force and effect.
30. No waiver
If we do not exercise or enforce a right under these Terms, that does not mean we waive that right.
31. Assignment
